These Terms and Conditions (“Terms”) govern the access to and use of the AIstats application, website, APIs, and related services (“Service”, “Application”) operated by AIstats Inc. (“AIstats”, “we”, “us”, “our”).

By accessing or using the Application, you confirm that you have read, understood, and agreed to be bound by these Terms, as well as our Subscription & Refund Policy and Privacy Policy.

2. Scope of These Terms

These Terms apply to:

  • mobile and web versions of the AIstats Application;

  • related APIs and backend services;

  • all paid and free features, including trials and subscriptions.

If you do not agree with these Terms, you must not use the Service.

3. Third-Party Platforms

If you download or access AIstats via the Apple App Store or Google Play, additional platform-specific terms apply:

  • Apple or Google may act as third-party beneficiaries of these Terms.

  • Payments, refunds, and subscription management for in-app purchases are governed solely by Apple or Google policies.

4. Eligibility & User Representations

By using the Service, you confirm that:

  • you are legally capable of entering into a binding agreement;

  • you are not located in a country subject to U.S. embargoes;

  • you are not listed on any U.S. government restricted or prohibited parties list;

  • you use the Service for lawful purposes only.

5. Account Registration & Security

5.1 Account Creation

Some features require account registration. You agree to provide accurate and up-to-date information.

5.2 Account Responsibility

You are responsible for:

  • maintaining confidentiality of your login credentials;

  • all activities performed under your account.

5.3 Security Breach

If you suspect unauthorized access or data breach, you must notify us immediately at support@aistats.pro. 

5.4 Account Restrictions

  • Automated or bot registrations are prohibited;

  • One account per user unless explicitly authorized;

  • Accounts may not be shared.

6. Subscriptions & Trials

AIstats offers auto-renewing subscriptions, including:

  • free or paid trials;

  • discounted introductory offers;

  • recurring billing (weekly, monthly, quarterly, or annually).

Full details are governed by our Subscription & Refund Policy, which is incorporated into these Terms by reference.

7. Payments & Authorization

7.1 Payment Method

By completing a purchase, you authorize AIstats to charge the provided payment method for:

  • subscription fees;

  • recurring renewals after trials or promotional periods.

7.2 Automatic Renewal

Subscriptions renew automatically unless canceled at least 24 hours before the next billing date.

8. Subscription Cancellation

8.1 Website Purchases

For subscriptions purchased via AIstats websites:

  • cancellation must be requested by contacting support@aistats.pro;

  • deleting the app or account does not cancel the subscription;

  • access continues until the end of the current billing period;

  • no refunds for unused time.

8.2 Apple App Store Purchases

Subscriptions must be managed via Apple ID settings. AIstats cannot cancel or refund App Store subscriptions on your behalf.

8.3 Google Play Purchases

Subscriptions must be managed via Google Play account settings. AIstats cannot cancel or refund Google Play subscriptions on your behalf.

9. Refund Policy

Refunds are governed by our Subscription & Refund Policy, summarized as follows:

9.1 Website Purchases

  • All payments are final and non-refundable, except where required by law;

  • Refunds may be granted at AIstats’ sole discretion.

9.2 App Store & Google Play

Refund requests must be submitted directly to Apple or Google, in accordance with their policies.

9.3 Legal Exceptions

  • California & Connecticut
    Residents of California or Connecticut may cancel their purchase at any time before midnight of the third business day following the date of purchase. In such cases, AIstats will refund the payment in full.

  • EEA & Switzerland
    Consumers based in the EEA or Switzerland have a statutory right to withdraw from contracts for the purchase of services. However, for single items of digital content (e.g., video recordings or PDF files), users expressly agree that the content will be made available immediately, thereby waiving the right of withdrawal and becoming ineligible for a refund.
    For subscriptions to our Service, which is provided on a continuous basis (such as app subscriptions), users expressly request and consent to the immediate supply of the Service. If a user exercises their right of withdrawal, AIstats will refund an amount reduced in proportion to the Service already provided before the withdrawal notice was received.

10. Content & Intellectual Property

10.1 Ownership

All content, software, data, and materials are owned or licensed by AIstats.

10.2 Restrictions

You may not copy, modify, distribute, reverse-engineer, or commercially exploit the Application without prior written consent.

11. User-Generated Content

Users are solely responsible for any content they submit. We reserve the right to remove content that violates these Terms or applicable laws.

12. Acceptable Use

You agree not to:

  • impersonate others or provide false information;

  • harass, threaten, or defame;

  • distribute malware, spam, or phishing attempts;

  • misuse APIs or scrape data;

  • use the Service for gambling or betting decisions.

Betting odds or analytics are provided for informational purposes only.

13. External Resources

The Service may link to third-party resources. AIstats is not responsible for their content, availability, or policies.

14. API Usage

API access is provided “as is”. AIstats is not liable for damages resulting from API use or interruptions.

15. Service Availability & Changes

We may:

  • update, modify, or discontinue features;

  • perform maintenance that may temporarily limit access.

Advance notice will be provided when reasonably possible.

16. Termination & Suspension

16.1 By User

You may terminate your account at any time. Active subscriptions remain valid until the end of the billing period.

16.2 By AIstats

We may suspend or terminate access if you:

  • violate these Terms;

  • misuse the Service;

  • trigger legal or regulatory risks.

No compensation is due for terminated accounts.

17. Disclaimer of Warranties

The Service is provided “as is” and “as available”. We do not guarantee uninterrupted, error-free, or fully accurate results.

18. Limitation of Liability

To the maximum extent permitted by law, AIstats shall not be liable for:

  • indirect or consequential damages;

  • loss of data, revenue, or profits.

Nothing limits liability for gross negligence, fraud, or personal injury.

19. Indemnification

You agree to indemnify and hold AIstats harmless from claims arising from:

  • violation of these Terms;

  • misuse of the Service;

  • infringement of third-party rights.

20. Governing Law & Jurisdiction

  • Governed by the laws of the State of Delaware, USA.

  • Disputes will be resolved in the courts of the Owner’s location, except where exceptions apply for European or UK Consumers.

21. Dispute Resolution

21.1 Amicable Resolution

Please contact support@aistats.pro before initiating legal action.

21.2 EU Online Dispute Resolution

European and EEA Consumers can resolve disputes using the European Commission’s dispute resolution platform available here.
